These Terms and Conditions apply to all purchases from our Web site. Please read them carefully before placing an order for goods on this Web site. If you do not agree to be bound by these Terms and Conditions, you should not order goods from this Web site.

Creation of a Contract for the Sale of Goods

1. We must receive full payment of the price of goods and the delivery charges before we can accept your offer to purchase goods from the Web site. On receipt of your offer, we will send you an acknowledgement email, to the email address you supplied on the registration form. This acknowledgement email will contain your order number, details of the goods ordered, total cost of the order etc. This email is not acceptance by us of your offer to purchase goods.
2. We will notify acceptance of your order by sending an email advising that your order has been accepted and despatched. This email constitutes acceptance by us of your offer and only at this stage is a binding contract created. Until this point you may vary or cancel your order.
3. We reserve the right to refuse any order prior to the email acceptance from us of your offer.

Prices

1. All prices and charges on this Web site are in UK Pounds Sterling and are exclusive of UK VAT. If VAT is to be charged, it will be displayed before you agree to purchase goods, when you view the goods you have selected in your basket. Delivery charges may apply and will be displayed in the order process.
2. Although we try to ensure that the prices quoted on our Web site are accurate, and the products have been fairly described, mistakes can occur. If we discover an error in the price of goods, or a material error in the description of goods, we will inform you as soon as reasonably possible, and we will give you an option to reconfirm your order or to cancel.
3. If we cannot contact you to advise of the error in price and/or description, we will treat the order as being cancelled. If the order is cancelled we will refund all money taken from you relating to the purchase of that good.
4. At any time before we accept your order, we reserve the right to adjust prices, offers, goods and descriptions of goods on the Web site.

Availability of Goods

1. All orders are subject to availability. If goods are not available, we will notify you of this within 30 (no more than) days of receipt of the order and provide a refund of the money paid to us, including delivery charges unless we agree a longer delivery period with you.
2. We reserve the right to withdraw any goods from the Web site at any time before we accept your order, and we will not be liable to you, or anyone else, for withdrawing goods.

Restrictions on Purchase

1. If you order goods with a minimum age requirement, by ordering it, you confirm that you are at least the minimum age. If we reasonably believe that you are not at least the minimum age to purchase the goods, we may cancel the contract at any time and provide you with a full refund of all money paid to us.

Delivery

1. We will make every reasonable effort to deliver goods to you within 30 (no more than) days of you making an order, and any other delivery times quoted on the Web site are estimates only.
2. We will deliver the ordered goods to the delivery address you supplied on the registration form. If, however, the goods are returned undeliverable, we will treat the contract as cancelled, and the money paid to us, excluding the delivery charge less administration costs of £25 will be refunded to you.
3. Although we will use all reasonable means to ensure the goods are delivered within 30 (no more than) days, we cannot accept responsibility for late deliveries that are due to circumstances outside our reasonable control. However, where reasonably possible, we will inform you if we become aware of any unexpected delay in delivery.
4. When the goods have been delivered to you, and you have paid the price, you will become the owner of those goods, at which point they will be your risk, and you will be liable for any subsequent damage, loss or destruction.

Cancellation

1. You have up to 8 working days, from the day you receive goods from us, to cancel your order, without having to provide us with a reason for cancellation.
2. If you wish to cancel and the goods have been delivered, or are subsequently delivered to you, you must keep them in your possession and take reasonable care of them until you return them to us. Goods should be carefully repackaged and returned to us complete, unused and in 'as new' condition, together with any accessories that were supplied with them.

5. If you cancel your order and the returned goods are in the condition required by these terms, we will refund the price of goods and delivery charges to you within 30 (no more than) days. We will not be liable for the delivery costs incurred by you for the return of the goods to us.

Return of Faulty Goods

1. If goods develop a fault within 12 months of delivery (or are otherwise defective) we may offer a repair, exchange or refund.

2. If products ordered are not as ordered or are damaged, faulty or incorrect in quantity, please contact us within 30 days of delivery at.

   At our discretion we may offer an exchange or a refund, or to make good any shortfall in quantity.

3. Where goods are faulty and we offer a refund, we will refund the cost of the goods, the initial delivery charge and the delivery costs incurred by you in returning the product to us.
4. Where possible, goods returned with a fault must be in 'as new' condition as possible, together with any accessories, and with the original invoice, or other form of proof of purchase, and proof of the return delivery costs incurred by you.
5. We will not offer a refund or exchange where faults are caused by accident, neglect, misuse, or normal wear and tear.
6. These Terms and Conditions do not affect your statutory rights as a consumer.

Severance

1. If any provision of these Terms and Conditions shall be unlawful, void, or for any reason unenforceable, then that provision shall be deemed severable from the Terms and Conditions and that provision shall not affect the validity and enforceability of any remaining provisions.

Governing Law

1. The Terms will be governed by and interpreted in accordance with the laws of Scotland and will be subject to the non-exclusive jurisdiction of the Scottish Courts. All rights not expressly granted are reserved to CaptainChainsaw.com.
